對(duì)修正案草案所做的修改將有助于依照“寬嚴(yán)相濟(jì)”的政策對(duì)國家的刑法體系進(jìn)行重組。

在上面的報(bào)道中，tempering justice with mercy就是“寬嚴(yán)相濟(jì)”，指在刑事處罰中將懲辦與寬大相結(jié)合，使犯罪人在受到嚴(yán)厲懲處的同時(shí)感受到刑罰的體恤與法律的公正。Temper在這里的意思是“使緩和，使溫和”，在法律英語中“寬大”這個(gè)意思多用leniency(名詞)或lenient(形容詞)來表示，比如，我們常聽到的“坦白從寬，抗拒從嚴(yán)”就可以用leniency to those who confess, severity to those who resist來表示。

Criminal Law(刑法)修正案草案中，對(duì)年齡在75歲以上的人一般將不采用capital punishment / death penalty(死刑)。此外，犯罪時(shí)不滿十八周歲的人不作為repeat offenders(累犯)。另外， pickpocketing(扒竊)也作為一項(xiàng)罪名列入刑法修正案當(dāng)中。
